Summary of Updated Process
The Board has updated the Association's Fine Policy and Enforcement Process to provide a more consistent, transparent, and fair approach to covenant enforcement while ensuring compliance with the Cherry Blossom Village By-Laws. One of the most important enhancements is the addition of a formal appeal process, giving every homeowner the opportunity to request a hearing before the Board prior to a fine being imposed.
The enforcement process begins with communication—not fines. If a covenant violation is identified, homeowners will first receive an initial courtesy notice describing the violation and providing ten (10) days to correct the issue. If the violation remains unresolved, a second and final courtesy notice will be sent, again providing ten (10) days to correct the issue. During this period, homeowners may also request a hearing before the Board if they believe the violation was issued in error or if they just wish to discuss the matter.
If the violation is not corrected and no hearing is requested within the required timeframe, a fine may be assessed in accordance with the Fine Schedule which can be found below. Homeowners continue to have the right to request a hearing after a fine has been imposed, provided the request is submitted within the required timeframe. Repeat violations of the same covenant within a twelve-month period are subject to increased fines, reflecting the Board's intent to focus enforcement on recurring violations rather than isolated issues.
